TERMS AND CONDITIONS

 
GENERAL POLICIES
  1. Final Confirmation: The definitive confirmation of the itinerary is formalized upon full payment for the service. Any subsequent modifications requested by the client shall be subject to additional charges.
  2. Rescheduling: In the event of rescheduling, prices may be adjusted in accordance with current rates and the availability of third-party providers.
  3. No-Show and Force Majeure: In the event of a “no-show,” adverse weather conditions, and/or unforeseen last-minute circumstances, no refunds of any kind shall be issued.
  4. Punctuality: It is the visitor’s responsibility to arrive punctually to execute the itinerary as agreed. Should the visitor arrive late to the designated meeting point, the lost time shall be deducted from the tour duration, or the itinerary shall be modified to fit within the originally agreed-upon timeframe.
  5. Itinerary Adjustments: The Company reserves the right to adjust the itinerary for operational, weather, or safety reasons, or due to causes beyond its reasonable control, including but not limited to: strikes, acts of terrorism, vandalism, epidemics, or border closures. Any significant modifications shall be notified to the client with as much advance notice as possible.
  6. Voluntary Non-Usage: No refunds shall be issued for any services that are voluntarily unused by the participants.
CANCELLATIONS AND MODIFICATIONS

Written Notice: Any cancellation or modification must be submitted in writing and shall be subject to the following penalties based on the date of notice:

  • More than 90 days prior to the event: 90% refund.
  • More than 60 days prior to the event: 80% refund.
  • More than 30 days prior to the event: 60% refund.
  • More than 2 weeks prior to the event: 50% refund.
  • Less than 2 weeks prior to the event: No refund shall apply.

Third-Party Cancellations: In the event of a cancellation due to causes beyond the control of both parties, a direct refund shall be issued to the client in accordance with the timelines stipulated above. Regarding any commissions agreed upon in this contract, no refunds of any kind shall be issued.

NUMBER OF PARTICIPANTS
  1. Reductions: Any subsequent reduction in the number of participants shall not result in an adjustment to the agreed-upon total price. 
  2. Increases: Any increase in the number of attendees shall be subject to availability and potential rate adjustments.
SECURITY AND LIABILITY
  1. Personal Property: The Company shall not be held liable for forgotten, damaged, or lost items or personal belongings of visitors occurring during the tour. 
  2. Assumption of Risk: The Company assumes no liability for any actions taken by the client during the event that jeopardize their safety and/or well-being. It is the visitor’s sole responsibility to follow the guide’s instructions to preserve their own safety and physical integrity. 
  3. Itinerary Integrity: Unauthorized stops or itinerary changes without prior notice to the guide and express authorization from the Company are strictly prohibited. Any modification must be reflected in the final quote accepted by both parties. 
  4. Vehicle Policies: Entering the vehicle with beverages that do not have a sealed lid or that pose a risk of spilling is strictly prohibited. 
  5. Cleaning Fees and Damages: An additional charge shall be applied in the event of damage to the interior or exterior of the vehicle caused by incidents such as vomiting or food/beverage spills. Cleaning fees shall be assessed and charged based on the magnitude of the damage.
CONDUCT AND USE OF ALCOHOL AND CONTROLLED SUBSTANCES
  1. Illegal Substances:

    The use of any narcotics or controlled substances that are illegal under Mexican law is strictly prohibited.

  2. Responsible Consumption:

    In events where the consumption of alcoholic beverages is included or permitted, participants are required to behave in a responsible manner.

  3. Right of Refusal and Removal:

    The Company reserves the right, at its sole discretion, to deny service or remove any participant from the tour or event who:

    • Is in an unfit state (including but not limited to intoxication or impairment).
    • Endangers their own safety or the safety of third parties.
    • Damages facilities, transportation, or equipment.
    • Fails to comply with the policies of third-party providers or local regulations.
  4. Waiver of Liability:

    The Company shall not be held liable for any accidents, injuries, damages, or losses resulting from the improper or excessive consumption of alcohol by participants.
